At DNRC we are passionate about ensuring that Montana’s land and water resources remain a benefit today and for future generations. *Water Rights Data Quality and Standards Section is *actively* seeking a Compliance Specialist who values the vast resources in our treasure state as much as we do* Work Unit Overview: * The Water Rights bureau administers the Montana Water Use Act under Title 85, Chapter 2, Montana Codes Annotated. This act provides for adjudicating Montana's existing or pre- 1973 water rights acquiring new water rights and changing existing water rights and maintaining a central­ized water right record system. The bureau provides technical and administrative assistance to the Water Court, is responsi­ble for formulat­ing rules and policy to address the examination of existing water rights, permitting new water rights and changes to existing water rights, and­­ provides work planning, support, and oversight to the Division's eight regional offices and the work units in Helena. The bureau provides technical information to the Montana Water Court in the statewide adjudication of all pre-July 1, 1973 water rights, oversees water right permit and change processes, maintains data quality and standards within the statewide administration of water rights, and provides water distribution tabulations to the Water Court. Program staff provide assistance and information to other agencies and the public regarding state water use laws, water availability, and local water use patterns. The bureau also manages water rights information in the state water rights records system. *Job Overview:* * This position is responsible for oversight and quality control of the program. Duties include statewide program direction and monitoring; develops and conducts training for bureau and regional staff, sets priorities and performance measures, evaluates performance and quality of work, distributes policies, performs data management functions, and performs a variety of duties related to the efficient operation of the program in meeting the goals of the bureau. The position reports to the Program Supervisor. The Compliance Specialist oversees the quality of work of water rights staff including the staff in the regional offices. The Compliance Specialist has the responsibility of resolving problems of detail, establishing a statewide quality control process, in addition to reviewing work products for accuracy, adequacy and timeliness, and recommending training. Also collaborates with the Program Supervisor with work planning for the bureau and regional offices. The position reports to the Program Supervisor. Work assignments are established through bureau goals and objectives and guided by water right legislation, administrative rules, and division and program policies and procedures (e.g., Montana Codes Annotated, Montana Supreme Court Rules pertinent to water rights). This position is responsible for developing the methods and procedures necessary to implement the program in an efficient and effective manner. Work assignments are generated by program needs, directives from the supervisor, bureau chief, and Water Court, and interaction with regional staff. The employee is expected to identify work objectives, identify activities for which development of new policies, procedures, rules, or legislation may be needed, and make recommendations to the Program Supervisor regarding the priority and amount of time that should be allocated to these activities. The employee is expected to work independently and with a great deal of discretion. The employee is responsible for designing work methods, strategies, policies, and solutions. The employee is expected to make decisions on the application and interpretation of policies and rules and communicate interpretations to staff, water right holders, attorneys, and others. Most proposed rules and policies are reviewed in draft form and finally approved by the Bureau Chief and Program Supervisor. Essential Functions (Major Duties or Responsibilities): */ These job functions are the essential duties of the position and are not all-inclusive of all the duties that may be assigned to the incumbent./ *Quality Control and Assurance: * Provide technical assistance, training and information to regional staff, Water Resource Supervisors, Regional office managers and bureau chief regarding regional office operating standards, program policies and procedures, legal issues, technical processes including GIS mapping and water right database application, data interpretation, and administrative practices and their application in various circumstances. Ensures policy is followed in a consistent and equitable manner across the state. This work requires an in-depth knowledge of program policies and legal requirements, and skill in communicating a variety of technical and legal issues in terms understandable to a wide range of audiences. Performs checks on water rights data to ensure work products are correct and complete. Works with agency personnel and external stakeholders to facilitate corrections as appropriate. Ensures that work products comply with statutory, rule, court orders, and administrative policy. *_Monitor and Coordinate Work Progress: _ Monitor the quality of work of the regional offices to ensure adherence to statute and guidance are met. Set performance measures and evaluate work performance of the program staff. Resolve problems and disputes that may arise in the coordination of the work progress. This work requires knowledge of the principles and practices of public administration and natural resource regulation; program goals and objectives regarding general water right program statutes, rules and policies; examination methodologies, GIS and database technologies, procedures, and comparison standards; Montana water law as contained in historical court orders, case law, and Attorney General Opinions; and skill and ability in compiling and synthesizing information, organizing workloads, and communicating effectively both verbally and in writing. Other Duties as Assigned: *Perform a variety of special projects, including conducting administrative hearings, attending trainings and continuing education, and representing the programs at conferences, meetings, and other events as assigned by the bureau chief. This involves tasks such as assisting in budgeting and bureau planning activities, assuming aspects of bureau management responsibilities in the chief's absence, assisting in the development and testing of computer programs. Minimum Qualifications (Education and Experience): The required Knowledge, Skills and Abilities are typically acquired through a combination of education and experience equivalent to a bachelor’s degree in the environmental sciences, natural resource management, or a related field, and experience in water resource administration including water rights, teaching, database structure, development, analysis and testing, program evaluation, and policy development. Required knowledge, skills, and abilities: The position requires an advanced knowledge of the principles and practices of natural resource management and program administration; the Montana water rights adjudication process; Montana Supreme Court water right claim examination rules, the Montana Water Use Act, the Water Rights examination manual, and court orders; knowledge of Montana Code Annotated and Administrative Rules of Montana; examination methodologies, procedures, and comparison standards; keep the records program for document storage and retrieval; program goals and objectives; GIS technology; water right data base; Montana water law as contained in the historical court orders, case law, and Attorney General Opinions; methods, and design; water use practices in Montana such as domestic, irrigation, stock, mining, municipal, commercial, and hydropower; and knowledge of personal and mainframe computers and program software applications. The position also requires a practical knowledge of teaching, administrative practices, and personnel and supervisory practices. Skill in: composing, drafting, and editing policies, statements, reports, memoranda, and letters; the operation of personal computers, water right database structure, operation and program data applications; concisely explaining issues and procedures to a wide variety of audiences; reading, understanding, and interpreting maps, plats, and aerial photographs; GIS mapping applications; and applying math for computing flow rates, volumes, and surface areas. Ability to: communicate complex technical and legal information verbally and in writing; establish and maintain effective relationships; work independently within program goals and objectives, establish schedules and deadlines; organize materials for efficient work output; train, guide, assist, and oversee the work of others; interpret and implement statutes, rules, laws, and policies; and conduct research and analyze facts to develop procedures for resolving controversial issues.
