This inspector is responsible for inspecting medical marijuana facilities to assure compliance with state regulations. The inspector will conduct inspections of licensed marijuana registered premises such as marijuana growing/cultivating facilities, marijuana-infused products manufacturing facilities, dispensary or retail shops, and chemical manufacturing facilities. Marijuana testing laboratories will also be inspected. This inspector will approve licensees in accordance with statutes, regulations, and local jurisdiction requirements and ensure employee status compliance. The inspector will perform other regulatory duties as allowed under the Montana Medical Marijuana Act.

Major Duties or Responsibilities:


Annual Inspections

  • Schedule and conduct unannounced on-site annual inspections of medical marijuana licensees to verify compliance with state and local jurisdiction requirements.

  • Document results of inspection.

  • Communicates deficient practices with licensee.

  • Verifies plans of correction meet minimum requirements.

  • Verify that compliance results are retained for facility files by transmitting compliance results to both the marijuana program database and licensee.

Pre-Licensing Activities

  • Verify licensee applications meet minimum standards for licensure.

  • Schedule and prepare for pre-inspections of prospective medical marijuana licensees.

  • Conduct on-site pre-inspections of prospective medical marijuana licensees to verify physical site and structure compliance with state and local jurisdiction requirements.

  • Assist license applicants as needed to meet standards for licensure.

  • Approve provisional license and conduct follow-up inspections as necessary to grant annual license.

Complaint and Fraudulent Activity Inspections

  • Receive complaints or identifies potential fraudulent activity.

  • Conduct preliminary investigations.

  • Determines if complaint or fraudulent activity can be resolved remotely or requires onsite investigation.

  • Schedule and conduct unannounced on-site inspection if necessary of medical marijuana licensees to validate or dispute complaint or fraudulent activity.

  • Document results of inspection.

  • Communicates deficient practices with licensee.

  • Verifies plans of correction meet minimum requirements.

  • Verify that compliance results are retained for facility files by transmitting compliance results to both the marijuana program database and licensee.

Training and Miscellaneous Functions

  • Assists with educational material preparation and training.

  • Participates in workgroups.

  • Serve as a resource on topics related to marijuana and the marijuana industry regarding the Montana marijuana program.

  • Assist with any other work assigned by the marijuana program manager or division administrator.

Physical and Environmental Demands:

This position works in a typical office environment with keyboarding and mobile device requirements. Extensive driving throughout Montana in various road and weather conditions to conduct assigned inspections/investigations and other duties may be required on a daily basis. Will travel throughout the State, including approximately 8-10 overnight stays per month. Extensive walking may be required during inspections. Site visits may expose the surveyor to unpleasant confrontation. Occasional out-of-state travel may be required for meetings or conferences.

Required Minimum Education and Experience:

  • Associates degree in Public Administration, Criminal Justice, Corrections or a closely related field of study.

  • OR One year job-related college or vocation training such as Public Administration, Criminal Justice, Behavioral Science, Inspection and Compliance, or Law Enforcement

  • Two years of job related work experience.

  • Other combinations of related education and work experience may be considered on a case-by-case basis.
